Limiting Fraudulent Lawsuits: It's About Time
In a recent hearing at the state affairs committee the question arose of what role the legislature should take, if any, in regards to silica and asbestos lawsuits. The solution to the problem might come from a freshman member of the House, who has called on his years as a medical doctor to craft a bill that is supported by many in the business world who have groused about the rising number of fraudulent claims now in the court system. These lobbyists are alleging that too many people get taken advantage of personal injury attorneys, who tend to be greedy and self-promoting. They can't do this, of course, without the help of doctors, who falsify or exaggerate X rays. Businesses are out thousands as they work to defend themselves against claims that have absolutely no merit. When you would like to get more information on personal injury lawyers check out this site.
There are personal injury lawyers who represent injured workers who don't want there to be any legislative action affecting their practices, especially when there are now laws on the books sending all the asbestos cases in a state to just one judge. However, in spite of their defense personal injury lawyers continue to create these fraudulent claims and are now particularly fond of a new variety which focuses on silica exposure.
The argument from businesses is to separate fraudulent claims from serious one by a requirement that claimants show proof they really sustained physical damage or effects due to being exposed to asbestos, not just damage that shows up on an X-ray. The bill being proposed would alter the bar association's current proposal requiring the claimants to satisfy a specific medical assessment involving a course of X-rays, doctor exams and breathing tests prior to being permitted to proceed with the proposed lawsuit.
In addition, this bill would offer a couple specific protections to workers who know they were exposed but haven't yet proven there was damage done. The first one would be the removal of the two year statute of limitations. The existence of this limitation sometimes forces people to fill prematurely. If a worker is prevented from following through with a claim, but finds later on severe symptoms have developed and will pass a medical test, the right to file suit again would be allowed no matter how long it's been. Also, the bill would ban insurance companies from denying coverage to workers that had previously had medical tests indicating a harmful exposure to asbestos. Protecting the workers is an important element of this legislation, but some critics indicate that the medical requirements are unfair. The new bill would more or less retain the current medical standards for the basis of litigation, but the judge in the case would be able to validate the medical qualifications of the case. The goal would be making sure a worker's current rights are maintained, while still being able to separate out the fraudulent, or totally frivolous claims.
House members claim that doctors who simply lie, as advocates of this bill claim they do, then raising medical standards won't fix the problem. Such a measure would not have the ability to keep dishonest physicians from altering their reports and diagnoses. Regardless of the motives, the state has an obvious interest to eliminate the fraudulent claims from the law system. Workers that actually have meaningful claims should hope to see their cases heard sooner. This bill, which has been submitted in the house, should be heard by the senate, according to the bill's sponsor.
Whats a good iPod Touch case!?!?
Whats a good case you recommend? I dont know which is better, silicone or hard plastic? I liked the see-through plastic cases, but now I'm not sure anymore. All the silicone cases i see don't cover the front at all. I want a case that covers the front (like those blacks parts on the bottom and top). Don't say Invisible Shield, i want an actual case that protects the iPod from shocks, or drops.
THANK YOU!
i have a tech glove fitting case it was 20$ at best buy i love it i had a clear plastic before and going in the cutouts for the buttons is horrid not the tech case has button like covers and it is simply amazing other than the clear actual screen covers I've had nothing but problems trying to put them on and i really want a mirror finish but im so afraid ill bubble it up and waste 15$ but ill get the link down below but i love it highly recommended it has a mat black finish the texture is nice tho not sooo slippy and when it clips shut u know its there very reassuring
